Modack trial: Judge rules evidence presented by new witness inadmissible

In the trial of alleged underworld gang boss, Nafiz Modack, presiding judge Robert Henney was involved in a heated exchange with Modack's lawyer before ruling evidence presented by a new witness was inadmissible.
Modack, who is on trial along with 14 others, faces 122 charges related to allegedly operating a criminal enterprise.
The charges include the murder of top cop Charl Kinnear, who was shot dead outside his Bishop Lavis home in 2020.

Modack's lawyer, advocate Bashier Sibda, called dismissed police warrant officer Riedewaan Titus to testify about alleged police corruption.
Titus was to corroborate the testimony of police captain Alfred Barker.
Barker told the court how R60,000 confiscated from a drug merchant in Mitchells Plain went missing in 2007, allegedly at the hands of top cops, retired general Jeremy Vearey and the late Kinnear.
Titus told the court he was at the scene when the money was confiscated, but before he could continue, he was halted by state prosecutor Greg Wolmarans.
