JOHANNESBURG - The State in the Senzo Meyiwa murder trial is set to defend its case against one of the accused on Tuesday morning in the Pretoria High Court.

This after Mthokoziseni Maphisa brought an application for his acquittal on Monday.

According to Maphisa, the State failed to prove his involvement in the football star’s 2014 murder.

Meyiwa was shot at the home of his girlfriend, singer Kelly Khumalo, in what the State believes was a hit.

Maphisa has argued that not only is there no proof of his involvement in the plan to kill Meyiwa, but the State’s main witness, Constable Sizwe Zungu, had no proof that there was such a plot at all.

His lawyer, Advocate Zithulele Nxumalo: "I submit there is no witness or witnesses that place accused number 4 at or near the scene of the crime. The witnesses who testified did not implicate accused number 4 as one of the intruders."

On Tuesday, the State will rebut the arguments by Nxumalo, defending its case against Maphisa.

If Maphisa has his way, he will be acquitted of Meyiwa’s murder but he will remain behind bars and continue serving a life sentence for a separate murder.
