In what is being described as a suspicious move, a Gauteng District Commissioner attempted to get his hands on all the dockets related to the murder of Vereeniging engineer, Armand Swart.

On Wednesday afternoon, the Madlanga Commission heard about how Acting Sedibeng District Commissioner Brigadier Mbangwa Nkhwashu instructed the investigating officer in the case to hand over all dockets to him.

Nkhwashu claimed he was instructed to obtain the dockets to hand over to Gauteng Provincial Commissioner Tommy Mthombeni, or face the possibility of disciplinary action. However, it emerged that Mthombeni’s office never formally communicated this instruction to the investigating officer.

Brigadier Nkhwashu alleged he was a suspect in the case involving murder-accused Katiso “KT” Molefe.

A recorded telephonic conversation was played before the Madlanga Commission on Wednesday between Nkhwashu and Witness B, the investigating officer in the Armand Swart murder case.

In the recording, Nkhwashu stated: "We got an instruction from the PC [Provincial Commissioner] to collect all those dockets, including that docket of yours and go give it to him. The instruction was given to us as District Commissioners. If we do not hand in those dockets to him, we’re going to be facing disciplinary steps."

Witness B told Nkhwashu she did not have the docket as it was with the Director of Public Prosecutions.

Nkhwashu told her to file a report in writing. But she said he later called Witness B back and told her that she should keep the dockets with her, raising serious suspicions about his motives.
