Judge Nompumelelo Hadebe said that oral and documentary evidence presented at the reopened inquest supported the notion that Luthuli was assaulted with a spade by apartheid police officers working in concert with employees from the South African Railway Company.
However, the judge said that all the seven implicated men had either died or could not be tracked down by the police.
Spokesperson for the Luthuli family, Sandile Luthuli: "The prosecution team very meticulously pointed to the institutionalisation of apartheid and the role that those institutions played in the cover-up of the murder of Chief Albert Luthuli. That we will have to look at when we study the detailed judgment in how it informs our next step forward."
