The National Prosecuting Authority (NPA) will not get involved in a dispute between the man accused of killing a witness at the Madlanga Commission of Inquiry and his legal team.

Matiphandile Sotheni, who appeared in the Brakpan Magistrates Court on Wednesday, is accused of murdering Marius van der Merwe in December last year, in full view of his family.

Sotheni, who is a former member of the South African Police Service (SAPS)’ Special Task Force, lashed out in the dock following the postponement of his case, claiming he had no hand in the murder.

He told the court that he did not know his lawyer and did not consult any legal representatives before his court appearance.

“It’s the first time I’m seeing this lawyer today [Wednesday]. He’s not being given instruction by me. He did not even take my statement. I’m arrested for something I didn’t commit.”

The NPA, however, said it would continue pursuing the murder charges against Sotheni, while allowing him the opportunity to resolve his dispute with his legal team.

“The State has nothing to do with who the accused appoint as his lawyer. The lawyers came on record and told the State that they would be representing the accused.”

Sotheni will return to court in May to continue his bid for bail.
