Alleged underworld gang boss Nafiz Modack was on Wednesday unable to explain to the court why co-accused Zane Kilian was tracking the whereabouts of slain top cop Lieutenant-Colonel Charl Kinnear before Modack claims to have instructed him to do so.

Modack and Kilian, along with 13 others, face a combined 122 charges for various crimes, including Kinnear's murder five years ago.

Modack is currently being cross-examined about his testimony related to Kilian "pinging" Kinnear’s cellphone for months before the anti-gang unit detective's eventual murder in September 2020.

Modack insisted that he only instructed Kilian to track Kinnear in June 2020. However, evidence collected by the Hawks shows Kilian was pinging Kinnear since March of that year.

State prosecutor Greg Wolmarans questioned Modack on Wednesday about why Kilian was pinging Kinnear without his instruction.

"How and why would Kilian be pinging Colonel Kinnear in March and April on three different numbers?" Wolmarans asked.

Modack responded: "I wouldn't know that, my lord."
