Evidence of illegal tracking and the testimony of co-accused Zane Kilian was used in the Western Cape High Court on Wednesday to show alleged underworld gang boss, Nafiz Modack, was involved in the murder of top cop, Lieutenant Charl Kinnear.

Modack remained defiant as the prosecution team questioned him about Kinnear's murder.

The top cop, who was investigating Modack at the time, was shot dead outside his Bishop Lavis home in September 2020.

Modack denied being involved in the murder of Kinnear on Wednesday as his cross-examination continued.

Evidence shows co-accused Kilian pinged Kinnear more than 2,000 times and was paid more than R200,000 in the months leading up to Kinnear's murder in September 2020.

Kilian previously testified that Modack paid and instructed him to ping Kinnear.

State prosecutor Greg Wolmarans showed the court screenshots of messages containing pings on Kinnear taken from Kilian' phone.

"So either this is part of a conspiracy, or I'm going to argue the evidence reveals that Kilian is reporting to you."

Modack: "That's false, my lord. There's no such evidence, my lord."

Modack is due back in the witness box for his cross-examination to resume on Wednesday.
