Alleged underworld gang boss Nafiz Modack has remained defiant during cross-examination about allegedly planning the murder of top cop Lieutenant Colonel Charl Kinnear.

Evidence of illegal tracking and the testimony of co-accused Zane Kilian was used in the Western Cape High Court on Thursday, to show Modack was behind the murder of Kinnear.

Kinnear was investigating Modack when he was shot dead outside his Bishop Lavis home in September 2020.

Evidence shows Kilian pinged colonel Kinnear more than 2,000 times, and was paid more than R200,000 before Kinnear's murder in September 2020.

Kilian has since testified it was Modack who paid and instructed him to ping Kinnear.

Modack insist Kilian and Kinnear were part of a conspiracy against him, on behalf of his alleged underworld rival, Jerome "Donkie" Booysen.

State prosecutor Greg Wolmarans showed the court screenshots of pings on Kinnear, which were sent from Kilian's phone.

"So, either this is part of a conspiracy, or I’m going to argue the evidence reveals that Kilian is reporting to you."

Modack: "that's false, my lord. There's no such evidence, my lord."

His cross-examination is set to resume on Thursday.
