The National Prosecuting Authority (NPA)’s head, Advocate Shamila Batohi, has struggled to back the allegations she has made against Johannesburg prosecutions boss Andrew Chauke at his inquiry.

Batohi has been testifying at the inquiry into Chauke’s fitness to hold office.

Her complaint against Chauke to President Cyril Ramaphosa is what prompted the inquiry and his suspension.

Batohi has accused Chauke of making politically motivated prosecutorial decisions.

One of the allegations against Chauke is that he attempted to reinstate the racketeering charges against former KwaZulu-Natal Hawks boss Johan Booysen, despite not having evidence justifying the charges.

Batohi was asked by Chauke’s lawyer, Advocate Tembeka Ngcukaitobi, to give the basis of this allegation.

“I can’t recall what his conduct was at that point regarding what happened, but for the appeal aspect, I’m not sure what advocate Chauke did.”

Batohi has failed to produce a document speaking to Chauke's role in the reinstating of Booysen's racketeering charges.

She has told the commission that she did not familiarise herself with the inquiry’s terms of reference and has denied being the main complainant, pushing that title to the president.
