The Western Cape High Court has set aside an Athlone Magistrates Court decision to deny bail for 10 Western Cape Anti-Gang Unit (AGU) members accused of murder.
The 10 AGU officers, and another who is already out on bail, were arrested in December after Manenberg resident Wade Price died in police custody.
On Friday, the High Court ruled that the 10 accused be released from custody after paying R2,000 bail.
Judge Mas-udah Pangarker has ruled for bail in the amount of R2,000 to be granted for the 10 AGU officers accused of murdering Manenberg resident Wade Price.
Earlier on Friday, defence attorneys argued the state and court failed to properly evaluate the circumstances of the case before bail was denied for 10 of the 11 accused.
Defence attorney for the accused, Bruce Hendricks, expressed delight at Pangarker's decision.
"We are astonished that bail was granted again and that justice prevailed. We are on our way to get the paperwork done and get our clients released," said Hendricks.
Hendricks said the bail appeal victory is a step in the right direction for the accused as they now prepare for the matter to go to trial.
