Judgment reserved in bail appeal of 10 Anti-Gang Unit members charged with murder

Judgment was on reserved on Friday in the bail appeal of 10 Western Cape Anti-Gang Unit (AGU) members charged with murder.

The 11 members were arrested after a Manenberg resident, Wade Price, died in police custody in November.

The defence appealed the initial bail judgement in the Western Cape High Court on Friday, after 10 of the accused were denied bail last month.

The officers are charged with murder, kidnapping, assault, torture and defeating the ends of justice.

Outside the court, police again separated protesters who came to support the AGU accused and a group gathered to support Price's family.

Defence attorneys argued on Friday that the State and court failed to properly evaluate the circumstances of the case before bail was denied for 10 of the 11 accused.

Prosecutor Kepler Uys told the court the charges against the accused were formulated based on strong evidence, suggesting Price was tortured.

Defence attorney for the accused, Bruce Hendricks, disagreed.

"There's no basis in law as to why these applicants should still remain in custody, and it appears the State has conceded that a lot of things were not considered," said Hendricks.

Judge Mas-udah Pangarker has reserved judgment in the matter to present her decision at a later stage.
