DURBAN - The murder trial of slain African National Congress (ANC) politician, Sindiso Magaqa, has been postponed to 6 February 2024.  

This is to allow the court to secure a date for accused number three, Mlungisi Ncalane, to be sent for psychiatric evaluation.

On Monday his lawyer, Advocate Shane Matthews, argued that his client was not fit to strand trial.

His father also testified in this regard.   

Tuesday’s court proceedings lasted all of 10 minutes. 

The State told the court that it was yet to determine a possible date for Ncalane’s to be sent for psychiatric evaluation. 

According to State prosecutor, Lawrance Gcaba, they may only be able to find a possible date next month. 

The matter has now been postponed to 6 February for the State to declare the date on record. 

Meanwhile, Ncalane remains in police custody.
