In an attempt to explain why the City of Tshwane’s chief financial officer (CFO) was assisting his brother with tender documents, Gauteng cop Sergeant Fannie Nkosi has told the Madlanga Commission the paper was to apply for a contract at a municipality that doesn’t seem to exist.

On Thursday, Nkosi testified that City of Tshwane CFO, Gareth Mnisi, helped his brother apply for a tender at the Mathew Phosa Municipality in Mpumalanga.

However, such a municipality doesn’t exist in Mpumalanga or even in South Africa.

Messages show Nkosi wanted the tender to go to his brother’s company, Ngaphesheya.

However, there was an issue as the company was not compliant with at least 12 of the bid specifications listed for the tender.

This didn’t stop the two from trying to secure the tender. Six months after the submission deadline, Mnisi was still giving Nkosi pointers on how Ngaphesheya can become compliant.

When asked about this, Nkosi said the pointers were for a different tender his brother was applying for in Mpumalanga.

“This project was for merely or barely meant for the Mpumalanga Mathew Phosa municipality.”

Mathews Phosa is a prominent anti-apartheid activist and African National Congress (ANC) stalwart who hails from Mbombela in Mpumalanga.

However, there is currently no municipality named after him.

At the same time, the commission has asked Nkosi to provide it with evidence of his brother applying for the tender.

Moreover, the Madlanga Commission has established that Mnisi and Nkosi are friends.

Nkosi took Mnisi to his first shooting range practice. They sometimes travel together and share an interest in motorbikes and cars.

However, their relationship also goes beyond that as Nkosi admitted to the Madlanga Commission that he had lobbied Mnisi to “open doors” for his brother.

“I’ve raised it with him that my brother is busy applying for different jobs there in Tshwane, and he is not getting any. And he said maybe something is not okay, can you please share his vendor so that I must check what the problem is.”

Evidence leader Matthew Chaskalson said the two have colluded in ensuring Nkosi’s brother’s company was awarded a tender it didn’t qualify for.
