Nafiz Modack's co-accused number two, Zane Kilian, is in the dock this week to prove he's not guilty of the charges he faces.
Kilian is accused of using a cellphone tracking application to locate the whereabouts of Kinnear on behalf of Modack.
During cross-examination, Modack's lawyer, Bashier Sibda, told the court his client never gave Kilian any instructions to ping Kinnear.
The State's evidence retrieved from Kilian's cellphone shows he was in contact with various numbers saved under Modack's name via WhatsApp.
Sibda put it to Kilian that the contacts were not Modack and could have been anyone using his name.
The cross-examination is set to continue on Wednesday for Sibda to clarify various payments made to Kilian from a business account allegedly linked to Modack.
