Mathipa was assassinated in 2023 while probing an abduction of two foreign nationals at the Mall of Africa in Midrand.
His investigation pointed to the involvement of the army’s Special Forces Unit.
But they deny any involvement in the kidnappings and the three murders that followed.
The State is opposing bail.
