Modack implicated in Heerschap murder through 'string of evidence'

Prosecutors in the Western Cape High Court on Wednesday used a string of evidence to implicate alleged underworld gang boss, Nafiz Modack, in the murder of Nicholaas Heerschap.

The State argued Modack was behind the murder of Heerschap, who was the father of a Hawks officer investigating Modack six years ago.

Modack and 14 others face 122 charges for various crimes, including Heerschap's murder in 2019.

State prosecutor Greg Wolmarans used documented evidence to show Nafiz Modack was aware Nico Heerschap was investigating him for commercial crimes.

Wolmarans also mentioned State witness, "Mister A", who testified how co-accused Ziyaad Poole instructed him to murder Heerschap on behalf of Modack.

The prosecutor also pointed to the alleged involvement of three other co-accused and the vehicle used in the incident, which was traced back to Modack’s brother, Yaseen Modack.

"It’s also just a coincidence that the Mercedes that links to your brother just happened to be reported stolen on 9 July. The anomaly of coincidence."

Wolmarans also told the court Heerschap previously testified he was on his way to testify against one of Modack’s bodyguards in a court matter involving an illegal firearm on the day his father was murdered.
