DURBAN - The State in the murder case of rapper Kiernan Forbes and celebrity chef Tebello Motsoane is opposing the re-application for bail of two of the seven accused.
Accused four and five have reopened their bail application, citing new facts.
The pair told the court their arrests have dented their businesses.
However, the State said nothing was new about the information presented in court on Thursday.
Accused number four, Mziwethemba Gwabeni, and accused five, Lindokuhle Ndimande said their incarceration has affected their families.
They told the court that since their arrest in 2024, their businesses have suffered.
Gwabeni said this has also impacted the payment of his children’s school fees.
Ndimande cited issues with his taxi business due to mechanical faults that cannot be addressed because he was behind bars.
Responding to the pair, Advocate Elvis Gcweka read an affidavit by investigating the officer in the case.
“The new facts raised are neither new nor are they sufficient to establish the existence of exceptional circumstances justifying their release on bail.”
Gcekwa added that based on insufficient evidence, the new application doesn't carry weight.
“Bail should, therefore, be refused.”
The matter continues in the Durban Magistrates Court.
