JOHANNESBURG - The High Court in Lilongwe, Malawi, is expected to hear the review application by fugitives, Shepherd and Mary Bushiri challenging their extradition to South Africa in July.

The controversial pair is asking the High Court to review and set aside the March judgment of the Chief Resident Magistrate that ordered their surrender to South Africa.

They’ve presented 15 grounds for review.

In papers, the self-proclaimed prophet contends that the magistrate erred in law.

In papers before the High Court, Bushiri argued that he will be surrendered to South Africa without knowing which rape charges he is supposed to answer to.

This, as the extradition docket did not name the alleged victims, only identifying them with alphabetical letters A to H.

Bushiri adds that the authority to proceed, issued by Malawi, only listed 3 counts of rape, not the 8 counts included in the extradition request.

The wanted fugitive said there is no evidence before court demonstrating that the 3 counts of rape on the granted extradition are the same counts the minister issued the authority for.

He complains an extradition on counts where there is no evidence is improper.
