Evidence leader says there's not enough proof to suggest Mbenenge didn't try to expose his penis to Mengo

JOHANNESBURG - Evidence leader in the tribunal investigating allegations of sexual harassment against Eastern Cape Judge President Selby Mbenenge said there wasn't enough proof to suggest that he didn't attempt to expose his erect penis to a junior staffer.
The head of the Eastern Cape division of the high court, in his evidence in chief, provided the Judicial Conduct Tribunal with a tracker report of the vehicle he was driving on the 14th and 15th of November, 2022.
But Advocate Salome Scheepers appeared dissatisfied with the evidence, arguing that there were gaps that judge president did not account for.

He is being investigated for alleged sexual harassment after high court secretary Andiswa Mengo accused him of making unwanted sexual advances towards her between 2021 and 2022.
Earlier this week, Mbenenge provided a tracker report for the 14th and 15th of November 2022, after Mengo alleged he summoned her to his chambers and attempted to expose his manhood to her.
"It makes it clear that I got to chambers around 9 o’clock. I left around 12 o’clock. The same goes for the 14th. I deny what you are suggesting."
In May this year, director of facilities and security management at the Office of the Chief Justice, Prabagaran Naidoo, presented the footage of the 14th, which reflected the movements around the chambers of the judge president.
In it, Mengo was not seen walking past his office in the video footage. However, evidence leader, Advocate Scheepers, said that the tribunal did not have the full video of the day and that there was no conclusive evidence before the tribunal that the incident did not happen.
Scheepers said there were several times when he was in the office and his secretary was not.
"The issue is whether it happened. It did not happen and on the objective facts that we have thus far, I think it’s demonstrabely clear that it did not happen. You can repeat it 200 times, it’s not going to change the situation. This is becoming malicious," Mbenenge said.
Mbenenge said that he takes exception to suggestions that he was trying to mislead the tribunal.
