CAPE TOWN - Justice and Constitutional Development Minister Mmamoloko Kubayi told Parliament that there were no cases of political influence against prosecutors and investigators.
Kubayi said there were sufficient checks and balances in place to prevent any potential external or internal influence in investigations by the Investigating Directorate Against Corruption (IDAC).
Minister Kubayi was responding to a written parliamentary question from the Economic Freedom Fighters (EFF) regarding allegations of executive interference and "undue political influence" in investigations made by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi.
The minister confirmed that the director of public prosecutions in KwaZulu-Natal had received an enquiry from the police and had dedicated prosecutors to deal with allegations of obstructing and defeating the course of justice.
She said this was regarding the disbandment of the political killings task team in KZN, allegedly at the request of suspended Police Minister Senzo Mchunu.
But Kubayi added that there were prescripts that guided the investigations and legal processes that the corruption-busting unit and the National Prosecuting Authority (NPA) must follow.
She said there were sufficient checks and balances to ensure that there was no interference "internal or otherwise".
Kubayi told Parliament that to date there had not been any interference in the matters that IDAC has been dealing with.
She further stated that her role as the minister was more "administrative and policy-oriented" and did not extend to involvement or "interference with specific prosecutorial decisions".
