Brian Wainstein murder trial: Court concerned about use of evidence against murdered accused

CAPE TOWN - The court in the high-profile trial related to the murder of "Steroid King" Brian Wainstein has raised its concern about the use of evidence of the murdered accused.
The matter is being heard in the Western Cape High Court on Monday.
Alleged underworld gang boss, Jerome Booysen, and 11 others are on trial for Wainstein's murder.
Wainstein was killed in his Constantia home in 2017.
Five of the accused in this matter have been assassinated since the trial started in 2024.
Western Cape High Court Judge Vincent Saldanha previously asked prosecutors to justify using evidence against co-accused Mark Lifman and Andre Naude.
Lifman, Naude, and three others were murdered since the start of the trial.
The State said its team was developing new arguments to ensure that Booysen and his co-accused were found guilty.
Saldanha has warned the State to address the court about how it intends dealing with evidence related to Lifman and Naude, as they are no longer alive to defend themselves.
Legal teams will continue arguing whether cellphone records extracted from the phones of Booysen, Lifman, and Naude is relevant and can be used as evidence in court.
