Business Unity South Africa (BUSA) has launched legal action against the Employment Equity (EE) Sector Targets, which took effect on 1 September.
The organisation says while it supports transformation and the EE Amendment Act; it argues that the latest targets are flawed in process and content.
“Our contention is that the process was not followed as set out in the law, which then gives rise to targets that are irrational and unimplementable.”

They state that there was insufficient consultation as employers had less than a week to respond, and there was a lack of transparency in how targets were calculated.

They also argue that the targets clash with existing B-BBEE codes and may be unworkable.
Mathe says they are calling for the targets to be set aside so that the correct process can be followed.
