Advocate Terry Motau has clarified that his decision to step aside as chief evidence leader of the Madlanga Commission was mainly over budget concerns.

Motau said the budget of R147 million allocated to the commission by the Department of Justice was simply not enough for the task at hand.

The commission was established by President Cyril Rampahosa to probe allegations that the criminal justice system in Gauteng has been infiltrated by criminal syndicates in cahoots with politicians and senior cops.

Motau specified that his decision to walk away boiled down to issues of uncertainty around the allocation of the budget.

Motau said his decision to step down as chief evidence leader of the Madlanga commission was communicated to commission chair, Justice Mbuyiseli Madlanga on 11 September, more than a week before he led the evidence of National Police Commissioner Fannie Masemola.

His main reason for pulling out of the commission was over budget concerns.

"To be able to perform a task of this nature, once government says they’ve given you a budget of R147 million, it’s not a lot of money for a task such as this one."

He believes the commission will succeed in its role of addressing allegations of corruption within the criminal justice system, but emphasises that evidence remains critical in ensuring the truth prevails.

"It’s not about what is said, it’s about what can be proven. It’s very early days."

Motau has been replaced by Advocate Matthew Chaskalson.
