Johannesburg prosecutions boss Advocate Andrew Chauke has denied the charges against him, arguing that they are vague and embarrassing.
An inquiry established by President Cyril Ramaphosa is investigating Chauke’s fitness to hold office.
This is based on prosecutorial decisions he made relating to former Crime Intelligence boss Richard Mdluli, and the racketeering charges against former KwaZulu-Natal Hawks boss Johan Booysen, which have since been dropped.
In his opening address on behalf of Chauke, Advocate Tembeka Ngcukaitobi said the charges against Chauke are based on a grave misunderstanding.
"They are also dangerous charges, and I don't say that lightly. What Mr Chauke is accused of is not dishonesty, it's not corruption, it's not Mala fide, he is accused of exercising prosecutorial discretion in a particular way."
