ActionSA’s mayoral candidate for Ekurhuleni, Xolani Khumalo, has been released on R2,000 bail.
On Monday, Khumalo made a brief appearance in the Palm Ridge Magistrates Court in Katlehong.
He faces charges including assault and pointing a firearm.
The charges relate to an incident that occurred last year, where Khumalo and two others allegedly assaulted an adult male during a reported drug busting operation.
Speaking outside court, ActionSA’s national spokesperson, Lerato Ngobeni, accused the State of trying to get Khumalo to spend the night behind bars over what she said was the small technical detail of verifying his address.
“What is appalling about this issue is that Xolani is a law-abiding citizen. He is fighting for the people of South Africa and Ekurhuleni, particularly, and drugs in our country that are being peddled by people who are nefarious and doing all kinds of things that are unjustified in our country, and he is the one that must be remanded in jail and not be let free because of a verification of his residence.
“His wife was able to spontaneously provide it as soon as the magistrate asked and that’s exactly what was going to happen if the investigating officer had done his job at the beginning of the day when Xolani handed himself over to the police.”

Following his release on bail Khumalo said he will continue fighting crime.
Khumalo was greeted with songs, hugs and kisses by his jubilant supporters as he exited the Palm Ridge Magistrates Court.
Similar scenes played out last year when Khumalo was acquitted for the murder of Robert Varrie in the same court.
Speaking outside court, Khumalo said his passion for fighting crime won’t be deterred.
“So, we are going to continue fighting drugs because we want to realise a drug free South Africa. We are doing it for our children. If they want to stop us, they must try other ways, but we will continue doing it, working with SAPS [South African Police Service]. We know very well there are police officers who want to do their jobs and are not lazy like others.”
Khumalo is due back in court on18th February 2026 when the State will be hoping to have secured the medical reports of the man he allegedly assaulted.
