The Madlanga Commission of Inquiry will make a ruling on Wednesday on whether alleged political fixer Brown Mogotsi is in contempt of a subpoena.
Mogotsi was due to appear before the commission on Monday; however, he called in sick.
He later submitted a medical certificate on that day, which the commission has taken into consideration.

As the Madlanga Commission gets to the tail end of its work, more witnesses are conveniently falling sick before they have to testify.
The commission’s spokesperson, Jeremy Michaels, recently told reporters it had remedies to deal with witnesses who do not cooperate.
“The commission has the option to find that he is in contempt, and the commission will deal with that on Wednesday morning, depending on what transpires between now and then. The commission does have the option of applying for a warrant of arrest for Mr Mogotsi if that is necessary.”
The commission resumes its hearings on Wednesday, with head of organised crime at the South African Police Service (SAPS) Richard Shibiri set to take the witness stand.
Shibiri has been implicated by previous witnesses of trying to bribe police officers and being in the pockets of suspected cartel members Katiso "KT" Molefe and Vusimuzi "Cat" Matlala.
