The National Prosecuting Authority (NPA) says it does not currently have sufficient evidence to prosecute a Johannesburg man arrested in connection with a fatal shooting in Emmarentia over the weekend. 

The NPA said the decision follows a comprehensive assessment of the evidence available at this stage and has concluded that further investigation is necessary to ensure that all relevant facts are fully explored before a final decision on prosecution can be made. 

The man, who had been taken into custody, has now been released.

What began as a minor car accident ended in a physical altercation that resulted in the death of one of the drivers and left a passenger injured after five shots were fired.  

NPA spokesperson Magaboke Mohlatlole says decisions to prosecute are based on credible and admissible evidence. 

"After careful consideration of the evidence in the alleged incident,  the NPA has decided not to prosecute or proceed with the case pending further investigations. So, the matter will be placed at some later stage when we feel satisfied with the evidence that we have."
