DURBAN - The murder trial of slain African National Congress (ANC) politician, Sindiso Magaqa, has been adjourned to Tuesday for the State to determine a possible date to admit accused three for mental evaluation.

On Monday, the State was meant to lead new evidence from a new witness.

But things took a different turn, with the lawyer representing accused three, Mlungisi Ncalane, telling the court that his client was not fit to stand trial.

Ncalane’s lawyer, Advocate Shane Matthews, has suggested that his client undergo psychiatric evaluation.

This after the Ncalane family informed his legal team on Monday morning that the accused murderer may be unfit to stand trial.

His father, Khuluphala Ncalane, explained his son’s condition to the court even though doctors previously said there was nothing wrong with him.

Ncalane remains behind bars.

The matter returns to court on Tuesday where a date for the medical evaluation will be determined.
