Legal expert weighs in on NPA's bid to overturn Omotoso's acquittal

JOHANNESBURG - A legal expert has weighed in on the National Prosecuting Authority’s (NPA) bid to overturn the acquittal of controversial pastor Timothy Omotoso, warning that it may prove challenging.
On Monday, the NPA took its first formal step, returning to the Gqeberha High Court to strengthen its case before approaching the Supreme Court of Appeal.
In April, the high court found the state failed to prove its case beyond a reasonable doubt, acquitting Omotoso of 30 counts, including rape, human trafficking, and racketeering.

Before the lengthy appeal process can formally begin, the NPA is seeking clarification from the same High Court on the reasons for Omotoso’s acquittal.
After that, it will have to file an application explaining the delay in launching its appeal and arguing that it has reasonable prospects of success.
However, legal expert Melusi Xulu said even if the NPA obtains clarity, the question of whether an appeal can succeed remains uncertain.
“It was a very scathing judgment for the NPA, because the court was concerned that they could have done a better job. The way they handled their case and how they structured their strategy — it was not good for the NPA.”
For now, both sides await High Court Judge Irma Schoeman's decision, expected next Tuesday.
