Madlanga Commission: Zuma and MK Party plead with court not to dismiss case on 'technicality'

Lawyers for former President Jacob Zuma and the MK Party have pleaded with the court not to award President Cyril Ramaphosa with another ruling on a 'technicality'.

The Pretoria High Court has been hearing arguments on whether the bid by the MK Party to challenge Ramaphosa's decisions is urgent. The party is challenging the establishment of the Judicial Commission of Inquiry into the Police and the appointment of Professor Firoz Cachalia as Acting Police Minister.

Arguing for the MK Party, Advocate Dali Mpofu has accused President Cyril Ramaphosa of attempting to avoid the merits of the case being heard in court.

The president's lawyers have argued that the matter is not urgent, as the commission of inquiry has started and Professor Firoz Cachalia has already been appointed.

Advocate Mpofu pleaded with the court not to award Ramaphosa with another ruling on a technicality, referring to the Constitutional Court that previously denied the party and its leader, former President Jacob Zuma, direct access.

The full bench led by Acting Deputy Judge President Letty Molopa-Sethosa will make a ruling on urgency on Thursday afternoon, which will determine whether the merits of the case are heard in court today.
