The Pretoria High Court has ruled that the bid brought by the uMkhonto weSizwe (MK) Party challenging the Madlanga Commission requires careful judicial consideration and should not be rushed.

On Thursday, the High Court struck the matter from the roll for lack of urgency.

The MK Party and its leader, former President Jacob Zuma, were trying to halt the commission, arguing that its establishment is unconstitutional.

The MK Party’s lawyers argued that their court challenge of the Madlanga Commission is inherently urgent, and it is of grave importance that the court allows it to proceed.

But the full bench that presided over the matter differed. The judgement was read by Judge Ronel Tolmay.

Now that the court has made this ruling, there are no more hurdles in the way of the Madlanga Commission of Inquiry.

The decision by President Cyril Ramaphosa to suspend Minister of Police Senzo Mchunu and appoint Professor Firoz Cachalia will also stand.
