The Commission of Inquiry into Truth and Reconciliation (TRC) cases will resume on Wednesday morning to hear arguments over a dispute.
The commission kicked off earlier in November but did not hear any oral arguments.
This was due to parties in the inquiry planning to bring a recusal application against chief evidence leader Advocate Ishmael Semenya.
Semenya was part of the counsel who worked on the National Prosecuting Authority (NPA) policy of 2005, which was developed to address apartheid-era crimes but was ruled to be unlawful by the Pretoria High Court.
It is on this basis that the families of apartheid victims, lawyers for the NPA and the Department of Justice believe that he should recuse himself from the matter.
On Wednesday morning, the commission, led by retired Justice Sisi Khampepe, will hear arguments on this recusal application.
Thereafter, the commission will make an order that will inform the way forward.
