Matiphandile Sotheni’s legal team has told the Brakpan Magistrates Court that they intend to bring a bail application when he appears next week.
 
The matter was previously postponed to May for a bail application. 
 
However, Sotheni’s newly appointed lawyer, Advocate Nthabiseng Mohomane, has argued that the date is too far. 
 
Sotheni faces six charges, including murder, conspiracy to commit murder, and the unlawful possession of a firearm and ammunition, in connection with the killing of Marius Van der Merwe, who testified before the Madlanga Commission under the pseudonym Witness D.
 
It is alleged that Sotheni tracked down, then shot and killed Van der Merwe outside his home in December last year.

“Upon receiving instructions, it is the attitude of the defence that the date is far and takes away the sense of urgency when it comes to the importance of a bail application,” said Advocate Mohomane.
