Modack trial faces another setback

The defence of alleged underworld gang boss Nafiz Modack has been dealt another blow in the Western Cape High Court during the Monday court proceedings.

Modack, who is on trial along with 14 others, faces 122 charges for various crimes related to allegedly operating a criminal enterprise.

Defence witness, police captain Alfred Barker, was back on the witness stand to be re-examined by Modack's lawyer.

Modack's lawyer, Advocate Bashier Sibda, attempted to present the court with new evidence.

Sibda told the court he had obtained voice recordings of conversations between Modack and Captain Alfred Barker.

Barker previously denied having any knowledge of Modack's plot to bribe senior police officers in an attempt to prove they were corrupt. 

Sibda said the voice recordings would show Barker was aware of Modack's plan.

However, presiding judge Robert Henney halted Sibda before he could proceed.

 "I don't know if I can allow this. You must make an application for me to rule whether this is in the interests of justice."

Henney later ruled that the evidence was inadmissible, saying Sibda had not laid a basis for the evidence to be permitted.
