Judge warns Nafiz Modack not to delay trial any further

Western Cape High Court Judge Robert Henney has warned alleged underworld gang boss Nafiz Modack not to delay the high-profile trial any further.
Modack, who is on trial with fourteen co-accused, faces 122 charges, including murder, extortion, racketeering, fraud and money laundering - all linked to the alleged operation of a criminal enterprise.
The matter was set to proceed on Wednesday, but was delayed yet again after Modack's lawyer requested a postponement.

Earlier this week, Modack told the court he intended to appoint a new Legal Aid lawyer.
On Wednesday, Advocate Bashier Sibda confirmed he will continue to represent Modack, putting that issue to rest.
Judge Henney then criticised Sibda for failing to produce a new witness to testify.
Furthermore, Judge Henney questioned why the court was assured a witness would be ready, only for the matter to be delayed.
“I will not hesitate to exercise the powers of the Criminal Procedure Act to close Mr Modack’s case."
Judge Henney granted the postponement, with the defence expected to call its next witness next week.
