JOHANNESBURG - Gauteng High Court Judge Nana Makhubele has been found guilty of gross misconduct and now faces impeachment in the National Assembly.

Makhubele has been facing a misconduct investigation for being a judge while she held the position of Passenger Rail Agency of South Africa (PRASA) board chair, a state-owned entity.

She is also accused of advancing corruption and state capture while she was at the entity.

Makhubele could become the third judge in democratic south africa to be impeached after the Judicial Service Commission (JSC) found her guilty of gross misconduct.

Makhubele was hauled before the judicial conduct tribunal after a complaint was laid by the civil society organisation #UniteBehind.

The group claimed Makhubele violated the separation of powers principle by being both a judge and chair of PRASA at the same time.

But she contended that while she was appointed by the president in January 2018, she had not taken her oath of office, meaning she was not yet a judge.

She is also accused of playing a role in State capture by advancing the interests of a PRASA contractor, Siyaya, which faces corruption allegations.

Makhubele’s matter has been referred to the Speaker of Parliament, who will begin her impeachment proceedings.
