They face 122 charges related to various crimes, including murder, extortion, money laundering and fraud.
The case against Modack and his 14 co-accused was postponed again on Monday due to the presiding judge not being available.
Presiding Judge Robert Henney initially postponed the matter in March this year, due to his involvement in a Supreme Court of Appeal matter.
State prosecutor Greg Wolmarens said the prosecution team were informed that Henney would not be available to preside over proceedings on Monday.
"We're alive to the fact that our normal presiding officer is not in attendance but we were duly informed this morning that the matter would be postponed until next week Monday."
The matter is set to proceed on Monday, 13 October for the availability of the presiding judge.
