Lawyers for the Cape Town Minstrel Carnival Association say the city has still not provided it with a new venue to host its minstrel competition.

It says it received a letter from the City of Cape Town on Tuesday evening saying it intends to appeal the ruling.

On Monday, the Western Cape High Court ordered the City to provide the association with an alternative venue for its minstrel competition after it had withdrawn its approval on the 22nd of September.

Association attorney, Junaid Jumat, says the City is in breach of the High Court order as its intention to appeal the matter does not suspend the court order.

"As it stands right now, the city has not yet filed any papers for a leave to appeal. They have only said so in a media statement and have indicated so to my client in a letter that we received at 10.40pm last night.  But that in itself does not suspend the current order." Jumat said.

He says the city's intention to share a list of private owned venues does not fall within the purview of relief ordered by the court.

Jumat adds that the main focus for the Cape Town Minstrel Carnival Association is to secure a venue.

He says the association has since appealed to the City to abide by the court order.
